These terms and conditions apply to all services of Equi Match Agency (“EMA”, “we”, “us”), including sales mediation, purchase mediation, marketing and related services.


By using our services, the customer (“customer”, “you”) agrees to these terms.


1. Services

EMA offers the following services:

  • Sales mediation: full support for the sale of horses/ponies, including intake, photography/video, advertising, social media, buyer contact, viewings, negotiations, contract management, export coordination, and aftercare. Sales mediation can be done on a no cure, no pay basis, with a commission due upon successful sale as agreed in the contract.
  • Purchase mediation: guidance through the purchase process, including intake, search profile, pre-selection, viewing, drive-through, negotiation, handling, and export/import. Purchase mediation is offered as a fixed package with a monthly fee.
  • Marketing services: social media management, photography/videography, advertising, content creation, website management, branding, and presentation. Marketing services can be purchased as a fixed monthly package or as individual services.


2. Contracts, exclusivity and costs incurred

  1. EMA always works on the basis of a written contract in which the scope, rates, services and obligations are laid down.
  2. With sales mediation on a no cure no pay basis, the commission is only due if the horse is successfully sold within the agreed period.
  3. During the contract period, EMA has the exclusive right to sell or broker the horse. If the client decides to sell or buy the horse outside of EMA, or otherwise uses services or materials provided by EMA, the client remains liable for all costs already incurred and agreed-upon fees.
  4. All work carried out by EMA, such as photography/video, advertising, marketing efforts, viewings, and negotiations, will remain fully charged if the client sells the horse or cancels services outside of EMA's involvement.
  5. EMA retains intellectual property rights to all materials it produces, such as photos, videos, texts, and advertisements. Use without written permission is prohibited.


3. Rates and payment

  1. Rates for services are agreed in writing in advance in the contract or quotation.
  2. Sales mediation can consist of a fixed amount commission.
  3. Purchase mediation and marketing services are invoiced based on the agreed monthly package or individual services.
  4. Additional services such as re-recordings, supplementary videos, export coordination, or special marketing campaigns may be invoiced separately.
  5. Payment must be made within the agreed-upon period after the invoice date. In the event of late payment, EMA reserves the right to suspend services.


4. Responsibility and liability

  1. EMA makes every effort to provide accurate information, but cannot guarantee that a horse will be sold or purchased within a specific timeframe or price.
  2. EMA is not liable for damage caused by errors made by third parties (e.g. transport companies, buyers or sellers).
  3. EMA is not responsible for the future performance, health or behaviour of the horse after transfer.


5. Intellectual property

  1. All photos, videos, texts, advertisements and other materials produced by EMA remain the property of EMA, unless otherwise agreed in writing.
  2. Reuse of materials by the customer without permission is not permitted.


6. Cancellation and termination

  1. Cancellation of services must be made in writing. Any costs already incurred or work completed will be charged.
  2. EMA reserves the right to terminate a contract in the event of non-compliance with these terms and conditions or non-payment.


7. Privacy

Personal data are processed in accordance with the EMA privacy policy, which can be found at www.equimatchagency.nl/privacybeleid/


8. Applicable law

These terms and conditions and all agreements between EMA and the customer are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
